The state of California has taken a hard stance on domestic violence charges and will often prosecute even if the accuser later recants the allegations. The accuser does not need to be a spouse; a fiancée, current or former spouse, a person you live with, parent of your child, or anyone you were dating can file a domestic violence report a person. The District Attorney’s office reviews all reports taken and completed by law enforcement and determines if criminal domestic abuse or related criminal charges should be filed in court.
